O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 9(B)(1)(b) of Explosives Act, 1884 and Section 5 of the Explosive Substances Act, 1908, in Crime 1/4

No.192 of 2025 on the file of the respondent Police, seeks anticipatory bail. 2.

The allegation against this petitioner is that, the petitioner is in possession of 561 of gelatin sticks and detonators for quarry purpose without any valid permit or bills. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution; that the A1 is the dealer involved in the supply of the gelatin sticks and he only supplied the sticks for the purpose of blasting work in his quarry and after using some gelatin sticks he has demanded A1 to take back the remaining gelatin sticks but it was not taken back and kept in the premises of the A1 and the A2 has also produced the receipt; that the petitioner herein is ready to co-operate for the investigation and that the petitioner is ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that the petitioner colluded 2/4

with A1 and collected 561 gelatin sticks and kept in a thatched shed without taking precautions and on inspection by the competent authority, for which, this petitioner has produced fabricated supply bill. A1 also admitted that he had provided fake receipt under the name of S.S.Mines and Minerals and thereby involved in the illegal supply of the explosives and the investigation is still pending.

Considering the submissions made on both sides and perused the materials available on record.

Considering the facts and circumstances of this case, gravity of offence, the fact that it is not only the case of illegal supply of gelatin sticks but it is also case of fabrication of documents and fake receipts to escape from the crutches of the law and taking note of the fact that the investigation of the case is pending, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, this criminal original petition stands dismissed. 21.01.2026 ssa 3/4
