ORDER
The petitioner who was arrested and remanded to judicial custody on 25.11.2025 for the offence punishable under Section 109 of B.N.S. in Cr.No.592 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner is the 2nd son of the de facto complainant, the petitioner left his wife Bharathi and his children and is living along with one Manju. On 21.11.2025, the collection agent informed that the vehicle loan of the petitioner was not paid and took possession of the vehicle. Even prior to that, the issue was informed to the petitioner and he demanded the de facto complainant to pay the said loan. On 25.11.2025, when Bharathi was going to work, the petitioner alleged to assault the said Bharathi with knife on her head, in that incident the said Bharathi sustained grievous injury. Hence, the case.
3. The learned counsel for the petitioner would contend that the petitioner is an innocent person and it is only a matrimonial dispute. He would further submit that the petitioner is physically challenged person, i.e., deaf and dumb. Further, the petitioner has no prevision cases.
Therefore, he prayed that the petitioner may be released on bail.
4. The learned Government Advocate (Criminal side) would submit that the petitioner assaulted his wife and she sustained injuries, investigation is pending and the injured was discharged from the hospital. Hence, he strongly opposed to grant bail to the petitioner.
5. Heard both sides and perused the materials available on record.

Considering the rival submissions made on either side, considering the nature of offences and considering the fact that the petitioner has no previous cases and it is only a matrimonial dispute and the injured was also discharged from the hospital and also the petitioner is in custody from 25.11.2025, this Court is inclined to grant bail to the petitioner, subject to the following conditions: [a] Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned X Metropolitan Magistrate Court, Egmore, and on further conditions that:
[b] the petitioner shall report before the respondent police daily at 10.00 a.m. until further orders;
[c] the petitioner shall not commit any offence similar to the offence of which he is accused, or suspected, or of the commission of which he is suspected;
[d] the petitioner shall not abscond either during investigation or trial;
[e] the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence; [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the0 Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
[g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.2023.
