ORDER

This criminal original petition has been filed to modify the condition imposed on the petitioner herein in Crl.M.P.No.11530 of 2025 dated 02.12.2025 by the learned Principal District and Sessions Court at Chennai, to the effect that the petitioner shall appear before the Respondent Police Station daily at 10:30 a.m., until further orders instead of the petitioner shall appear before the Malaikottai Police Station, Trichy daily at 10:00 a.m., until further orders. 2.

The learned counsel appearing for the petitioner submitted that, the petitioner herein was granted anticipatory bail by the Principal Sessions Judge, Chennai, vide order dated 02.12.2025 in Crl.M.P.No.11530 of 2025 for the offence under Sections 329(4), 296(b), 74, 351(1) of BNS @ 329(4), 296(B), 74, 351(1) of BNS r/w 92(a) of the Rights of Persons with Disabilities Act, 2016 in Crime No.423 of 2025 on the file of the respondent police with one of the conditions that, the petitioner shall appear before the Malaikottai Police Station, Trichy daily at 10:00 a.m., until further orders. He further submitted that the petitioner is complying with the conditions regularly from 09.12.2025; that since the petitioner is residing at Chennai along with his family and sole bread winner of the family, he finds it very difficult to comply with the said condition, hence prays to modify the aforesaid condition. 2/4

The learned Government Advocate (Crl. Side) appearing for the respondent submitted that, the petitioner has complied with the aforesaid condition for 18 days; and the the investigation of the case is pending. 4.

Considering the submissions made on both sides, the nature of offence, the fact that the petitioner has complied with the aforesaid condition for a considerable period of time, this Court is inclined to modify the aforesaid condition to the effect that the petitioner shall appear before the learned V Metropolitan Magistrate, Egmore, Chennai daily at 10:30 a.m., for a period of three weeks and thereafter, as and when required for interrogation by the respondent police. As far as the other conditions imposed on the petitioner herein in Crl.M.P.No.11530 of 2025 dated 02.12.2025 remain unaltered. 5.
