ORDER

The petitioner who was arrested on 26.11.2025 and remanded to judicial custody on the same day for the offences punishable under Sections 408, 409, 477 (A), 468, 471, 420 read with Section 34 of IPC in Cr. No.3 of 2025 on the file of the respondent police seeks bail.

2. The case of the prosecution is that there was a misappropriation committed in the H.H612 C-Serpananthal Primary Agricultural Cooperative Credit Society with regard to issuances of Jewel Loan. The misappropriation has been committed in the said society during the period from 2020 to 2022 to the tune of Rs.1.49 Crores. The Deputy Registrar of Cooperative Societies, Thiruvannamalai District ordered enquiry under Section 81 of the Act and subsequently Section 87 surcharge order has been passed against the petitioner and others. Thereafter, the Deputy

Registrar of Cooperative Societies lodged a complaint against the petitioner and 2 others and on the basis of the said complaint, the respondent police registered the FIR.

3. The learned counsel for the petitioner would contend that the petitioner was arrested and remanded to judicial custody on 26.11.2025. Further, the petitioner's property worth Rs.2 Crores has been attached. Hence, she prayed that the petitioner may be released on bail.

4. The learned Government Advocate (Criminal Side) would submit that there is already three cases pending against the petitioner the offences are grave in nature and the investigation is at initial stage and hence he strongly opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the rival submissions on either side, considering the nature of offences and taking note of the fact that the petitioner's property worth Rs.2 Crores has already been attached, this Court is inclined to grant bail to the petitioner subject to the following conditions:

[a] Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.10,000/- each (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Principal District and Sessions Judge, Thiruvannamalai, and on further conditions that:

[b] the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.

[c] the petitioner shall not commit any offence similar to the offence of which they are accused, or suspected, or of the commission of which they are suspected;

[d] the petitioner shall not abscond either during investigation or trial;

[e] the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer or tamper with the evidence; [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court

himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.2023.
