Challenging the order passed by the Principal District Munsif Court, Thirukovilur, dismissing the application in I.A.No.804 of 2015 in O.S.No.76 of 2014 to condone the delay of 180 days in filing an application to set aside the ex parte decree, the present revision has been filed. 2.The suit in O.S.No.76 of 2014 has been originally filed by the 1st respondent for declaration of title and for recovery of possession. The said suit was decreed ex parte on 22.12.2014. Thereafter, the petitioners have filed the present application to condone the delay of 180 days in filing an application to set aside the ex parte decree. The said application has been dismissed by the trial Court. Challenging the same, the present revision has been filed.
3.When the matter was taken up for hearing, the learned counsel for the petitioners would submit that, pursuant to the decree, execution proceedings were initiated and ultimately, possession was also taken and the Execution Petition has also been terminated. The learned counsel further submitted that the 2nd petitioner has already filed a suit in O.S.No.65 of 2018 on the file of the Principal District Munsif Court, Thirukovilur, to set aside the judgment and decree in O.S.No.76 of 2014, and the same is pending.
4.In view of the submissions made by the learned counsel for the petitioners, let the parties agitate their case in the pending suit. Nothing survives in this revision petition for adjudication. Accordingly, this Civil Revision Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
