O R D E R

This petition has been filed to modify the condition that the petitioner shall deposit a sum of Rs.5,00,000/- before the Judicial Magistrate No.IV, Pondicherry imposed in Crl.M.P.No.2258 of 2025 on the file of the Principal Sessions Judge, Pondicherry dated 19.11.2025

2. It is submitted that the petitioner herein was alleged to have been involved in the case of investment fraud to the extent of Rs.23,46,000/- and since the petitioner was arrested, while granting bail, the learned Principal Sessions Judge, Pondicherry imposed a condition that the petitioner shall deposit a sum of Rs.10 lakhs and subsequently the same was modified to the extent of Rs.5 lakhs and further submitted that, already one of the properties also identified for attachment and the petitioner is in custody from 16.10.2025 and more than three months in custody and final report also filed in this case and prays to modify to deposit Rs. 5 lakhs.

3. This Court while granting bail to A1 in Crl.O.P.No.1667 of 2025 has imposed no condition of deposit and it is also placed on record that one of the properties which alleged to have been purchased form the cheated amount is also in the process of attachment

4. In view of the above, the condition imposed in Clr.M.P.No.2258 of 2025 by the learned Principal Sessions Judge,, Pondicherry with regard to deposit of Rs.5,00,000/- before the Judicial Magistrate No.IV, Pondicherry shall stands deleted and the other conditions remain unaltered.
