ORDER

The petitioner/accused A4, who was arrested and remanded to judicial custody on 17.11.2025 for the offence punishable under Section Section 420 of IPC r/w 120(b) of Indian Penal Code, 1860 and Section 66D of IT Act, in Crime No.20 of 2025 on the file of the respondent police, seeks bail.

The case of the prosecution is that defacto complainant one Sudha Karthick, lodged a complaint with the respondent police on 04.06.2025 alleging that the complainant invested in an online crypto trading platform named "linch2024.net" through Telegram and transferred approximately Rs.24,89,665/- to various unknown merchant bank accounts. The complainant later realized she was cheated and the website refused to return her alleged balance of Rs.29,84,761/- and demanded further Rs.12 lakhs to release the funds. Hence the case.

3. The learned counsel for the petitioner would contend that the petitioner is an innocent and a false case has been foisted against him. He would further submit that there is no previous case as against the petitioner and he is no way connected with the said occurrence. Hence, he seeks bail.

The learned Government Advocate (Crl.Side) appearing for the respondent would submit that petitioner and other accused cheated the defacto complainant to the tune of Rs.29,84,761/- on the guise of investment in crypto bitcoin. He further submitted that it is a cyber fraud. Huge amount is involved in this case. Hence, he opposed to grant bail to the petitioner.

Heard both sides and perused the materials available on record including the First Information Report.

Considering the rival submissions made by the learned counsel on either side, the nature of the offence, the period of incarceration undergone by the petitioner and also the fact that there is no previous case is pending against the petitioner, this Court is inclined to grant bail to the petitioner, subject to certain conditions.

[a] Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the XI Metropolitan Magistrate at Saidapet and on further conditions that:- [b] the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders;

[c] the petitioner shall not commit any offence similar to the offence of which he is accused, or suspected, or of the commission of which he is suspected;

[d] the petitioner shall not abscond either during investigation or trial;

[e] the petitioner shall not directly or indirectly make any 3/6

inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence; [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
