ORDER

The petitioner, who was arrested and remanded to judicial custody on 27.05.2025 for the alleged offence punishable under Sections 310(2) of BNS Act, 2023 in Crime No.341 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner joined hands with other accused broke open the defacto complainant's house and committed theft of 19 1⁄2 sovereigns of gold jewels and 165 grams of silver articles. Hence, the complaint was lodged, and the petitioner was arrested and is in judicial custody.

3. Earlier, this Court dismissed the bail petition filed by the petitioner in Crl.OP.No.33030 of 2025 dated 02.12.2025 on the following reasons: "6. Considering the submissions made by the learned counsel on both sides, the fact that only a portion of the stolen properties was recovered, and that the petitioner has 14 previous cases of a similar nature pending against him, this Court is of the view that, if he is released on bail at this stage, the petitioner is likely to indulge in similar activities. Therefore, this Court is not inclined to grant bail to the petitioner"

4. Now, the learned Government Advocate (Crl. Side) appearing for respondent police submitted that the petitioner has 28 previous cases pending against him. Hence, he vehemently opposed to grant bail to the petitioner.

5. Considering the submissions made by the learned Government Advocate (Crl.Side) and in the absence of any change in circumstances, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 07.01.2026 drl 2/4
