ORDER

The petitioner, who was arrested and remanded to judicial custody on 07.11.2025, for the alleged offence punishable under Section 397 r/w 34 of IPC, in Crime No.521 of 2010 on the file of the respondent police seeks bail. 1/4

2. The allegation against the petitioner is that he was earlier released on bail in S.C.No.302 of 2013 and thereafter jumped bail. Subsequently, a NBW was came to be issued against him on 16.07.2013. As the petitioner remained absconding for a long period, the NBW could not be executed and the same was executed only on 17.11.2025. Hence, the case. 3.The learned counsel appearing for the petitioner submitted that the petitioner was not aware of the pendency of the Session Case and that summons were not served on him. He further submitted that he was residing at the same address, and that due to lack of knowledge about the case, he did not appear before the Court. He further submitted that the petitioner has six previous cases, out of which some cases are pending and some ended in acquittal. Hence, he prays to grant bail to the petitioner.

4.The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner failed to appear before the Trial Court on 16.07.2013, as a result of which the case remained pending for a long time. He further submitted that the petitioner had absconded and was arrested only on 07.11.2025. He further submitted that the trial has now commenced and therefore, oppose to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record 2/4

including the First Information Report.

6. Considering the nature of the allegations and the fact that the petitioner had remained absconding for a long period after jumped bail, this Court is not inclined to grant bail to the petitioner.
