ORDER

The petitioners were arrested and remanded to judicial custody on 19.11.2025 for the alleged offence punishable under Section 309(4) of BNS Act, 2023 in Crime No.1165 of 2025 on the file of the respondent police, seeks bail. 1/4

2. The allegation against the petitioners is that they joined hands with other accused, waylaid the defacto complainant and robbed a sum of Rs.9.32 lakhs. Hence, a complaint was lodged and the petitioners were arrested.

3. The learned counsel appearing for the petitioners submitted that the petitioners have been in judicial custody since 19.11.2025 and are ready and willing to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for respondent police reiterated the prosecution case and submitted that there are totally five accused in this case and the petitioners are ranked as A1 and A2, being the main accused. He further submitted that a sum of Rs.2.89 lakhs was recovered from the first petitioner and Rs.2.54 lakhs from the second petitioner. Out of the total amount of Rs.9.30 lakhs, only Rs.6.14 lakhs has been recovered so far and the remaining amount is yet to be recovered and that the investigation is still pending. Hence, he opposed to grant bail to the petitioners.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions made by the learned counsel on either side, the fact that only a portion of the robbed amount was recovered, that the petitioners are the main accused in this case, and that there is a likelihood of the 2/4

petitioners indulging in similar activities if they released on bail, therefore, this Court is not inclined to grant bail to the petitioners.
