The petitioner, who was arrested and remanded to judicial custody on 04.06.2025 for the offences punishable under Sections 296(b), 332(b), 118(2), 127(2), 109, 103(1) of BNS and Section 7, 8 of POCSO Act in S.C.No.213 of 2025 on the file of the Sessions Division of Ranipet, Ranipet District, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 16.12.2025 in Crl.O.P.No.34450 of 2025.

The case of the prosecution is that, the petitioner herein and the defacto complainant are residing in the same village; that it is alleged that the petitioner herein had stalked the defacto complainant's daughter; that when the same was objected by the defacto complainant's daughter, the petitioner got enraged, trespassed into the defacto complainant's house and assaulted the defacto complainant's daughter with knife; that when the defacto complainant's sister's daughter tried to prevent the petitioner, she was also brutally assaulted by the petitioner; that due to which, both the victims in this case sustained grievous bleeding injuries; that on hearing the screaming of the victims, the neighbours broke open the house door, caught hold the petitioner herein and handed over him to the respondent police; that the defacto complainant's daughter in this case died on the spot and the other 2/4

victim had sustained severe injuries and admitted in hospital. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner is a young boy aged about 19 years and has no previous antecedents; that the petitioner is in judicial custody since 04.06.2025; that after dismissal of the earlier bail application of the petitioner by this Court in Crl.O.P.No.34450 of 2025, the investigation of this case was completed and final report filed in S.C.No.213 of 2025 on the file of the Sessions Division of Ranipet; and that the petitioner is ready to abide by any condition that may be imposed by this Court, hence prays to grant bail to the petitioner. 4.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that there are totally two victims in this case, one of the victim died and the other had sustained grievous injuries; that the investigation of this case was completed and final report filed. Considering the submissions made on both sides, grave nature of 3/4

offence, the manner in which the occurrence is said to have taken place and the fact that the present bail petition is filed immediately after the dismissal of the earlier bail petition of the petitioner in Crl.O.P.No.34450 of 2025 without any change in circumstances, this Court is not inclined to grant bail to the petitioner.
