ORDER

The petitioner, who was arrested and remanded to judicial custody on 03.10.2025, for the alleged offence punishable under Section 17, 5(j)(ii), 5(1), 5(n) and section 6 of Protection of Child from Sexual Offences Act, 2012 and

75 of Juvenile Justice Act, 2015 and 351(2), 49, 65(1) of BNS Act, 2023 [506(ii),109 and 376(3) of IPC] in Crime No.51 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he is the father of the 16 year old victim girl, taking advantage of her loneliness and age, the petitioner committed aggravated penetrative sexual assault, which resulted in her pregnancy. Hence, a complaint was lodged and the petitioner was arrested.

3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and has been in judicial custody since 03.10.2025. He further submitted that the petitioner is ready to abide by any conditions imposed by this Court. Hence, he prayed for the grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) for the respondent police reiterated the prosecution case and submitted that the victim girl has categorically stated in her statement that the petitioner committed aggravated penetrative sexual assault, and the DNA test is pending. Hence, he opposed the grant of bail to the petitioner.

5. I have gone through the statement of the victim girl, which reveals very

disturbing facts, including the manner in which she was subjected to aggravated penetrative sexual assault. The DNA report is also awaited, and if the petitioner is released on bail, there is a likelihood that he will tamper with the witness. Hence, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
