ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 316(4) of BNS in Crime No.295 of 2025 on the file of the respondent Police, seeks anticipatory bail.

2.The allegation against the petitioner is that the petitioner, who is a salesman, induced the defacto complainant by falsely representing a business transaction relating to supply of goods and received huge amount on various dates, totalling Rs.33.20 lakhs. Subsequently, petitioner failed to supply the goods. It was later revealed that the accused had misappropriated the money for his personal gain. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to cooperate for the investigation and ready to abide by any stringent condition that may be imposed by this court and prays for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.side) for the respondent police reiterated the prosecution's case and on instructions submitted the petitioner has misappropriated a huge amount of Rs.33.20 lakhs, and investigation in this case is progressing and granting anticipatory bail to the pertinent at this stage will hamper the investigation, thereby, she raised strong objection.

5. Heard both sides and perused the records including the FIR.

Considering the facts and circumstances of this case, the submissions made by the learned counsel appearing on either side, a huge sum of money is swindled by the petitioner by misrepresentation and investigation is pending, so far no money is recovered, I am not inclined to grant anticipatory bail to the petitioner.
