ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 316(2), 316(4), 318(2), 318(4) of BNS Act, 2023, in Crime No.224 of 2025 on the file of the respondent Police, seeks anticipatory bail.

2.The allegation against the petitioner is that the petitioner, while working as the in-charge of the finance company, misappropriated funds amounting to Rs.4.81 lakhs, by failing to deposit customer's payment into the company's bank account. Hence, the case.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person, has not misappropriated the funds as alleged by the prosecution and the entire transactions were taken place only the year 2021 and the petitioner has also repaid the entire amount. Hence, he prayed for the grant of anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.Side) for the respondent police reported that the defacto complainant has clearly detailed the transactions, the total amount misappropriated by the petitioner, and the names of the affected customers, establishing a prima facie case of the misappropriation. Hence, she apposed for grant of anticipatory bail to the petitioner. 5.I have also gone through the records and perused the FIR, which revealed that the petitioner herein has indulged in misappropriation of the customers money to the extent of Rs.4.81 lakhs and so far no amount has been

repaid and considering other facts and circumstances of this case, hence I am not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. 19-01-2026 gbi Index:Yes/No Speaking/Non-speaking order Internet:Yes
