ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326(a) of BNS in connection with the Cr.No.663 of 2025, seeks anticipatory bail.
2. The allegations against the petitioner on 23.12.2025, petitioner illegally transported 3 unit of gravel sand in a Tipper lorry bearing registration
No.TN 15 MC 4524 without any valid permission. On seeing the defacto complaint, the petitioner escaped from the scene of occurrence. Hence, the case.
3. Learned counsel for the petitioner submitted that the petitioner is an innocent person, and he has been falsely implicated in this case by the respondent police and prays for grant of anticipatory bail to the petitioner.
4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and on instructions, submitted that 3 unit of sand has been illegally extracted from the river and opposed for grant of anticipatory bail to the petitioner.
5. Considering the nature of offence committed by the petitioner, and taking note of the fact that the petitioner is not only involved in quarrying river sand but also in damaging the ecology and the river bed itself, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. 12-01-2026 Jai
