O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 109, 351(3), 103 of BNS @ 61(2), 49, 191(3), 103(1), 351(3) of BNS in Crime No.437 of 2025 on the file of the respondent Police, seeks anticipatory bail. 1/4

The allegation against this petitioner is that, the petitioner who is ranked as A6 in this case is having sister with whom the deceased had a love affair. In order to murder the deceased in this case, this petitioner engaged A1 to A5 and paid money to them and on his instructions, A1 to A5 attacked with patta knife and murdered him. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution; is ready to co-operate for the investigation process and that the petitioner is ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that after the investigation the final report was filed and the same was taken on file in PRC.No.32 of 2025 on the file of the Judicial Magistrate-I, Mayiladuthurai, and NBW was issued against the petitioner.

Considering the submissions made on both sides and perused the materials available on record.

Considering the facts and circumstances of this case, gravity of offence, and taking note of the fact that the NBW was also issued against this petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
