ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 194 of of BNSS @ Sections 69, 318(4), 108 of BNS in Crime No. 581 of 2025, on the file of the respondent Police, seeks anticipatory bail. 1/4

2. The case of the prosecution is that the victim girl, aged about 18 years, was working under the petitioner in a shop. Somehow, the petitioner herein had developed a relationship with the victim and had sexual intercourse with the promise of marrying her. Since he refused to marry her inspite of her request, she committed suicide after writing a suicide note. Hence, the complaint.

The learned counsel for the petitioner submitted that the petitioner is only a Manager and his relationship with the victim is not like lover and victim was also having a love affair with other person. Since the petitioner has raised objections, she committed suicide. Therefore, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reported that the FIR was registered for suspicious death, and the suicide note revealed that the petitioner had sexual intercourse with her and subsequently refused to marry her. Hence, the victim girl committed suicide by hanging. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Earlier this court has dismissed the bail petition of the petitioner in Crl.OP.No.29782 of 2025 vide order dated 03.11.2025 on the ground that the case is in investigation stage.

6. Considering the facts and circumstances of the case, nature of allegations and the submissions made by learned counsels on either side and since there is no change in circumstances, after dismissal of earlier petition, this Court is not inclined to grant anticipatory bail to the petitioner.
