ORDER
The petitioner, who apprehends arrest by the respondent police for the offences punishable under Sections 8(c), 20(b)(ii)(c), 25, 29(1) of NDPS Act, in Crime No.770 of 2025 registered on the file of the respondent police seeks anticipatory bail.
2. The allegation against the petitioner is that he is ranked as A4 in this case. On prior information, the respondent police conducted a search and seized 1.250 kg of ganja from A1 to A3. On investigation it was revealed that they had purchased the contraband to a total quantity of 2 kg of ganja by paying Rs.1,000/- from the petitioner herein. Hence, the present case.
3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that only based on the confession statement of the coaccused, the petitioner is arrested and that he is ready to co-operate with the investigation. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted
that the petitioner is the supplier of 2 kg of ganja, out of which 1.250 kgs of ganja was recovered from A1 to A3 and that the investigation is pending. Hence, she opposed the grant of anticipatory bail to the petitioner.
5. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl.side) and perused the materials available on record.

Considering the fact that the petitioner is the main accused and the alleged supplier of 2 kg of ganja and that the seizure is only 1.250 kgs of ganja and that investigation is pending, this Court is of the view that if the petitioner is released on bail, at this stage, there is a likelihood of indulging in similar activities. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
7. Accordingly, this Criminal Original Petition is dismissed. 21-01-2026 drl
