CMP.No19977 of 2018 in S.A.No.1766 of 2002 RMT.TEEKAA RAMAN,J., This petition is filed to withdraw the Memo dated 06.07.2018 giving up the second respondent in the above second appeal.

2.Learned counsel appearing for the appellants in the Appeal has stated that the second respondent/Saroja died on 19.06.2017. The case was listed on 06.07.2018. On that day, the junior counsel representing for the appellants, inadvertently filed a Memo dated 06.07.2018, giving up the deceased/ second respondent. Again, it was adjourned ''for arguments'' on 25.07.2018.

On that day, on the basis of the above said Memo, the second respondent was given up.

3.Now, it is submitted by the learned counsel for the appellants the said Memo was filed inadvertently. Hence, he prayed to withdraw the said Memo.

4.Taking into consideration, the entirety of the circumstances of the case, this petition is allowed as prayed for.
