O R D E R
The Transfer Civil Miscellaneous Petition has been filed seeking to withdraw the case in O.P.No.48 of 2018 on the file of the Family Court, Kanyakumari, Nagercoil, (Originally in IDOP. No.440 of 2017 on the file of the District Court, Kanyakumari, Nagarcoil) and transfer the same to the file of the Family Court, Chennai.
2. Today when the matter is taken up for hearing, the learned counsel for the petitioner submits that the learned Judge, Family Court, Kanyakumari, has dismissed the petition in O.P.No.48 of 2018 for default and the wife was set exparte before the said Court and there is no petition pending before the Court below as on date. Hence, nothing survives for adjudication in the present transfer civil miscellaneous petition.
3. In view of the above submission made by the learned counsel for the petitioner, this Transfer Civil Miscellaneous Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
