O R D E R

This civil miscellaneous petition has been filed to condone the delay of 386 days in filing the above civil miscellaneous appeal in C.M.A.SR.No.68047 of 2017 as against the judgment dated 04.05.2016 passed in O.A.(II U).No.171 of 2014 on the file of the Railway Claims Tribunal, Chennai Bench.

2. Heard the learned counsel on either side.

3. It is seen that this Court, vide order dated 06.01.2021, dismissed this petition and consequently, rejected the appeal at the SR stage itself. The said order was carried to the Hon'ble Supreme Court by the petitioners by way of Civil Appeal No.4487 of 2026 in which, the Hon'ble Supreme Court, vide order dated 16.04.2026, set aside the order dated 06.01.2021 dismissing this petition and allowed the appeal, thereby, condoning the delay of 386 days in filing the above appeal in C.M.A.SR.No.68047 of 2017 and remitted the matter to this Court for consideration of the appeal afresh on merits with a request to dispose the same preferably within a period of six months.

4. In view of the aforesaid order dated 16.04.2026 passed by the Hon'ble Supreme Court, no further orders needs to be passed in this civil miscellaneous petition.

5. Registry is directed to number the civil miscellaneous appeal, if it is otherwise in order and post the matter for admission in due course. 2/4

6. In the meantime, the learned counsel for the petitioners shall serve a copy of the typed set of papers on the learned counsel appearing on behalf of the respondents.
