2. The learned counsel for the respondent would submit that it is a second round of litigation suppressing the earlier proceedings. The Plaintiff had approached the lower court seeking for permanent injunction with unclean hands. Hence, the defendant had filed a petition to reject the plaint and the same was allowed. Against which, this Second Appeal has been filed.
3. The learned counsel for appellant would submit that the plaintiff is not interested in proceeding with the case. On the other hand, the defendant is able to establish that the plaint, as it is not maintainable in law. Accordingly, the trial court had accepted and allowed the petition to reject 2/4
the plaint filed under Order VII Rule 11 of C.P.C. in I.A.No. 608 of 2012. Therefore, this Second Appeal is dismissed on the ground of no instructions on the side of plaintiff and the order passed by the learned District Munsif, Ponneri in I.A.No.608 of 2012 in O.S.No.89 of 2012 is confirmed. No costs. Consequently, the connected Civil Miscellaneous Petition is closed. 15.07.2022 rpp To Sub-Judge, Ponneri.
