J U D G M E N T

The learned counsel appearing for the appellant submits that during the pendancy of the appeal, the entire amount was settled in favour of the workman and hence nothing survives for adjudication in this appeal and also made the following endorsement in the petition: 'Trial court award already paid.

Therefore nothing survives. Lordship may be permitted to confirm the trial court award and close the CMA'.

2.In view of the endorsement made by the learned counsel appearing for the appellant, this civil miscellaneous appeal is dismissed. The award dated 12.05.2016 in W.C.No.66 of 2009 on the file of the Deputy Labour Commissioner - II, at Teyanampet, Chennai, is confirmed. No costs. Consequently, the connected miscellaneous petition is closed.
