ORDER

(Order of the Court was made by Dr. Anita Sumanth J.) These two miscellaneous petitions seek restoration of writ appeals in relation to W.A.No.1967 of 2012, which was dismissed for default on 01.12.2016 and W.A.No. 1969 of 2012, which was also dismissed for default on 01.12.2016 as against the second respondent. The petitioner has not sought restoration of W.A.No. 1968 of 2012, which was also dismissed for default on 01.12.2016. 2.

We find from the verification of the docket orders that the matter was admitted as early as on 10.09.2012. When the matter came up on 01.12.2016, the following order has been passed:- "The appellant (s) / petitioner (s) is / are directed to pay batta to the concerned respondent(s) on or before 23-122016, failing compliance, all appeals/petitions are deemed to have been dismissed."

In fact, the second respondent has passed away even on 30.08.2016, prior to order dated 01.12.2016 and till date, there is no move on the part of the assessee to have served the respondents or bring on record the legal heirs of the second respondent.

In view of the aforesaid circumstances, we find no justification whatsoever to indulge the petitioner in these petitions. To be noted that in the impugned order of the writ court, at paragraph 12, liberty had been granted to the writ petitioners to move the civil court and seek appropriate remedies. Hence it is for the petitioners to have done the needful. 5.

Dismissed.
