C.M.P.No.17450 of 2018 in C.M.A.No.SR22624 of 2018 T.RAJA, J.

This miscellaneous petition has been filed to condone the delay of 181 days in preferring the appeal against the decretal order dated 30.6.2017 passed by the ESI Court in E.I.O.P.No.171 of 2003.

2. Learned counsel for the petitioner submitted that when the decretal order has been passed after three years from the date of closure of the company, the petitioner was unaware of the order passed. After coming to know of the order passed against the petitioner, they have collected all the papers for filing appeal and in the meanwhile, the delay has occurred. Therefore, the delay is neither wilful nor wanton, but only due to the bona fide reasons mentioned above.

3. Learned standing counsel for the respondent has no serious objection for condoning the delay.

4. Taking note of the fact that the decretal order was passed three years after the closure of the petitioner company, it is a fit case for condoning the delay. Accordingly, the delay is condoned and the C.M.P.No.17450 of 2018 stands allowed.
