C.M.P.No.20351 of 2018 in S.A.No.SR67129 of 2018 P.T.ASHA, J., This Civil Miscellaneous Petition is filed for condoning the delay of 800 days in filing the Second Appeal.

2. The private notice had taken to the respondents have been served on 13.11.2018 and 28.11.2018 respectively. Though the court notice is yet to be awaited. The fact that the private notice has been served, this court has taken up the application for hearing, the respondents have not entered appearance through counsel before this Court for condoning the delay of 800 days and filing the above SA.SR.No.67129 of 2018.

3. The reasons given for the delay is that the parties were admitting to bring about and ambiguous settlement in the dispute which had been ultimately failed. Thereafter the appeal has been filed in and by which the inordinate delay had been occurred.

4. The reasons given in the affidavit is sufficient. However considering the delay this Court is of the opinion that the delay may http://www.judis.nic.in

P.T.ASHA, J., jrs be condoned on condition of term that the petitioner is directed to pay a sum of Rs.1500/- to the Advocate Clerks Welfare Association by 13.12.2018. The delay is condoned and the petition is allowed.

5. Post the matter on 14.12.2018 under the caption for reporting compliance.
