Prayer: Writ Petition numbered under Article 226 of the Constitution of India, on transfer of O.A.No.2343 of 2003 from the Tamil Nadu Administrative Tribunal at Chennai, praying to issue a Writ of Certiorarified Mandamus to set aside the order passed by the first respondent in Na.Ka.No.5421/A/2000 dated 17.04.2001 and the second respondent in Na.Ka.No.8310/B/2000 dated 30.04.2001 and direct the respondent to fix the pay respectively and the same may be paid to the petitioner herein. ORDER

The petitioner herein claims pay anomaly with that of two employees, namely, R.Krishnamoorthy and R.Muthusamy. According to the petitioner, these two co-employees are his juniors. https://hcservices.ecourts.gov.in/hcservices/

2. The learned Government Advocate appearing for the respondents, on written instructions, submitted that the petitioner herein was promoted as a Fireman Driver on 09.03.1997, whereas his two co-employees, namely, R.Krishnamoorthy and R.Muthusamy, were promoted on 20.06.1975 and 06.02.1976 respectively. Apparently, the petitioner herein is junior to these two co-employees and therefore may not be in a position to claim Special Grade of pay on par with these two co-employees.

3. In view of the said submission, I do not find any infirmity in the impugned orders dated 17.04.2001 and 30.04.2001, rejecting the petitioner's claim for Special Grade of pay. Hence, the Writ Petition stands dismissed. No costs.
