Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of writ of mandamus to direct the Secretary to Government, Municipal Administration and Water Supply Department, Fort St.George, Chennai -09, the 1st respondent herein to fix the scale of pay of the applicant in the post of Municipal Commissioner in which the applicant was posted and acted such as Grade I and Senior Grade II, which the applicant was posted and acted to the higher responsibilities and pay all the arrears due to the applicant in view of the above refixation within a short date.

The prayer made in this writ petition is to issue a writ of mandamus to direct the first respondent to fix the scale of pay of the petitioner in the post of Municipal Commissioner, in which, the petitioner was posted and acted as Grade I and Senior Grade II officer and pay all arrears due to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

2.This petition was originally filed before the Administrative Tribunal in O.A.No.2156 of 2004. Subsequently, it was abolished and hence, the petition was transferred to the Writ Court and renumbered as W.P.No.17697 of 2007. The matter is pending before this Court for more than 13 years.

3. Today, when the matter is taken up for hearing the learned Additional Government Pleader for the respondents submitted that the relief sought for in this writ petition has been granted to the petitioner. He has also produced a copy of the letter dated 01.12.2020 of the Commissioner of Municipal Administration, to that effect. The learned counsel for the petitioner also accepted the same.

4. In view of the subsequent developments and the submissions made by the learned counsel on either side, nothing survives for adjudication in this writ petition. Accordingly, the writ petition is dismissed as having become infructuous. However, there shall be no order as to costs.
