the Trial Court seeking to dissolve the marriage between the appellant and the first respondent which held on 17.07.1970, wherein the Trial Court vide order dated 09.11.2016 dismissed the said petition. Challenging the same the present appeal has been preferred. He further submitted that the wife of the appellant / first respondent passed away. Hence, the prayer sought for in this appeal has become infructuous.

2. In view of the above submission made by the learned counsel for the appellant, this Civil miscellaneous appeal is dismissed as infructuous. No costs.
