Respondent Prayer :- Civil Revision Petition is filed under Section 25 of the Tamil Nadu Buildings (Lease & Rent Control) Act, to set aside the judgment decree dated 04.07.2018 passed in R.C.A.No.458 of 2015 on the file of the VII Small Causes Court, Chennai confirming the judgment and decree dated 20.07.2016 made in R.C.O.P.No.362 of 2015 on the file of the XII Small Causes Court, Chennai.

ORDER

This Civil Revision Petition has been filed challenging the order dated 04.07.2018 passed by the learned VII Judge, Small Causes Court, Chennai, in R.C.A.No.458 of 2015, confirming the order dated 20.07.2016 passed by the learned XII Judge, Small Causes Court, Chennai in R.C.O.P.No.362 of 2015, thereby evicting the petitioner from the petition premises.

The petitioner is the tenant and the respondent is the landlord. The respondent filed petition in R.C.O.P.No.362 of 2015 as against the petitioner for eviction and handed over the vacant possession. The learned Rent Controller by an order dated 20.07.2016 directed the petitioner to vacate the petition premises and handed over the vacant possession to the respondent within a period of two months. Aggrieved by the same the petitioner filed appeal before the learned Rent Control Appellate Authority in R.C.A.No.458 of 2016 and the same was dismissed on 04.07.2018 by confirming the order passed by the learned Rent Controller. Aggrieved by the same the present Civil Revision Petition.

Today, when the matter is taken up for hearing, the learned counsel appearing on either side submitted that the petitioner vacated the petition premises and handed over the vacant possession to the respondent. Therefore, the revision petition has become infructuous and nothing survive in this petition.

Accordingly, this Civil Revision Petition is dismissed as Infructuous. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
