JUDGMENT

This Second Appeal has been filed to set aside the judgment and decree made in A.S.No.10 of 2014 dated 30.10.2015 on the file of the learned District Judge, Perambalur confirming the judgment and decree made in O.S.No.350 of 2012 dated 22.08.2012 on the file of the learned District Munsif, Perambalur.

2.When the Appeal was taken up for hearing today, the learned Counsel appearing for the Appellant submits that the Appellant is reported dead. Therefore, he seeks to close the Second Appeal and in case, the legal heirs approach the learned Counsel for the Appellant, he may be permitted to re-open the case.

3. Considering the submission of the learned Counsel for the Appellant, the Second Appeal is dismissed as abated. No costs. 03.04.2024 2/4
