J U D G M E N T

(Judgment of the Court was delivered by V.M.VELUMANI,J.) The appellant/husband filed H.M.O.P.No.561 of 2012 under Section 13(1)(i-a) of Hindu Marriage Act, on the file of the Principal 1/4

Family Court, Coimbatore, for dissolving the marriage between the appellant and respondent that took place on 01.06.2001. By the order dated 11.10.2017, the said H.M.O.P.No.561 of 2012 was dismissed. 2.Challenging the said order and decree dated 11.10.2017 made in H.M.O.P.No.561 of 2012, the appellant has come out with present appeal.

3.When the matter is taken up for hearing today, both the learned counsel appearing for the appellant as well as the learned counsel appearing for the respondent submitted that parties have arrived at settlement before the Tamil Nadu Mediation and Conciliation Centre, Coimbatore, that they have no further claims or demands against each other and filed settlement agreement dated 03.11.2022, duly signed by both the appellant as well as respondent and their respective counsel. They also requested this Court to pass a decree for divorce by mutual consent.

4.The said Settlement Agreement dated 03.11.2022, duly signed by both the appellant as well as respondent and their respective counsel is 2/4

taken on file and the same is recorded. Recording the Settlement Agreement dated 03.11.2022 and the submissions of the learned counsel appearing for the appellant as well as the respondent, this Civil Miscellaneous Appeal is disposed of by dissolving the marriage solemnized between the appellant and respondent on 01.06.2001 in terms of Settlement Agreement. The Settlement Agreement dated 03.11.2022 shall form part of the decree. No costs.
