(a) Directing the defendant to pay the plaintiff the sum of Rs.1,24,75,000/- (Rupees One Crore Twenty Four Lakhs and Seventy Five Thousand Only) together with interest at 9% per annum on the sum of Rs.1,00,00,000/- (Rupees One Crore Only) from the date of the plaint till the date of realization; and (b) Directing the defendant to pay the plaintiff the costs of the above Suit.

J U D G M E N T

It is stated by the learned counsel on either side that the matter has been settled between the parties before the Division Bench of this Court in O.S.A.No.207 of 2019 and a Joint Memo of Compromise dated 01.02.2022 has been filed before the Division Bench. They have also produced a copy of the judgment dated 02.02.2022 passed by the Division Bench in O.S.A.No.207 of 2019 in this regard.

2.Accordingly, the Suit is dismissed as settled out of Court as the matter is settled between the parties. No costs. Consequently, connected application is closed.

3.Registry is directed to refund the Court Fee, as per Rules. Index : Yes/No Speaking / Non-speaking order TK
