These petitions have been filed on the side of the appellants (i) to condone the delay of 217 days in filing the petition to set aside the abatement caused due the death of the sole respondent, (ii) to set aside the abatement caused due to the death of the sole respondent, (iii) to bring on record the respondents 1 to 5 herein as the legal representatives of the deceased sole respondent and array them as respondents 1 to 5 in A.S.No.468 of 2012.

2. There is no representation on the side of the respondent and being satisfied with the reasons stated in the affidavits filed in support of the above petitions, these Civil Miscellaneous Petitions are allowed.

3. List the matter after three weeks.
