O R D E R

Today when the matter is taken up for hearing, on behalf of the respondents/Port Trust, an affidavit of undertaking has been filed, which is extracted hereunder. "1.

I submit that I am the 3rd

respondent in the above matter and am competent to sear to this undertaking on behalf of other respondents also as compliance report in the above petition.

I submit that as per the directions of this Hon'ble Court, I have complied the order dated 05.09.2017 in W.P.No.27976 of 2014 and I also filed a compliance report to this Hon'ble High Court on 19.12.2018. This Hon'ble Court though satisfied with the compliance report, had directed to me to file an affidavit of undertaking as regards to the promotions to be effected as and when vacancy arises, as per the seniority list.

I hereby submit that action has been initiated for filing up the vacancies as per the seniority list and hereby undertakes that further promotions will be effected as and when the resultant vacancies on account of retirement on superannuation/promotion to the higher cadre."

In view of the above, no further orders are necessary in the contempt petition and the same stands

closed. In case, any party has any grievance against the action taken by the respondents/Port Trust in pursuance of the order of this Court, it is always open to them to work out their remedy in the manner known to law. Consequently, connected sub application is closed.
