S.Karunakaran And Another v. S.Chandrasekaran And Another
in C.V.KARTHIKEYAN, J.
Written-statements have been filed by the First and Second Defendants.
2. Application has been filed in the suit for partition seeking injunction restraining the defendants from alienating the property morefully described in the suit schedule property.
3. In any suit for partition, it is only appropriate that the property is retained for the Court to pass a preliminary decree. If the parties are permitted to deal with the property, then taking a decision in the suit itself would become a futile exercise. It is informed that one fourth (1⁄4) of the property had already been sold to a third party purchaser, who had been impleaded. Let no further transaction be done conveying any further portion of the suit property. If at all any one of the parties seek to deal with the property they must obtain leave of this Court, inform the other parties to the suit about their intention to so deal, inform the Court about
the names and addresses of the respective purchaser and in the recital of any conveyance deed mention about the pendency of the suit and specifically inform the said purchaser and that the conveyance is subject to the orders of the Court.
4. With those observations, this application stands disposed. 13.09.2022 sms/Maya 1/2
