Written statement in the suit was filed with the delay of 62 days and the same was condoned by this Court on 22.11.2019. From that day onwards, the plaintiffs have been taking time to file re-joinder. For the said purpose, this Court adjourned the case on 11.12.2019, 07.01.2020, 10.01.2020 and finally today i.e., on 04.02.2020.

2. The learned counsel appearing for the plaintiff would submit that the re-joinder application filed in the Registry has been returned and seeks time.

3. This Court adjourned the matter many hearings for the sake of rejoinder. This Court, already taking cognizance of the written statement and the draft issues filed by the respective parties, has framed issues as early as on 16.07.2019 and the same shall be retained for trial, since no new facts to frame additional issue arise. Since the matter is now ripe for trial, this Court is of the view that the application No.8640 of 2018 filed for interim direction to the respondent/defendant to furnish security need not be taken up separately that can be decided in the suit finally.
