The learned counsel for the petitioner and the learned counsel respondent are present.

It has been submitted by the learned counsel for both the parties that in the report of the Advocate Commissioner for the share of 1785 Sq.Ft in the third option, it has been wrongly mentioned as South Western Corner of the Compound Wall instead of South Eastern Corner of the compound wall as per sketch.
3.The learned counsel for both the parties agreed to divide the suit property as per the third option as suggested by the learned Advocate Commissioner as per the Sketch submitted by him. ie. South Eastern Corner of the compound wall.

In view of the aforesaid submissions made by the learned counsel for both parties, this application is allowed and accordingly, based on the report of the Advocate Commissioner and Sketch, final decree is passed directing the defendant to handover the vacant possession within a period of four months from today and in the meanwhile,the statement of accounts including mesne profits and other details for maintaining the suit schedule property shall be filed within a period of 12 weeks.
