Company Application No.667 of 2018 Company Application No.667 of 2018 in Company Petition No.370 of 2015 KRISHNAN RAMASAMY, J.

This Application has been filed to implead the Ex.Director of Shriram Venkataramanan as respondent No.5 in Company Application No.248 of 2017.

2. The learned Official Liquidator submitted that since this Court, by its order dated 20.06.2018, has discharged the respondents 1 to 3 as they resigned prior to the orders of winding up, the present application is filed to implead other two Directors as respondents. The learned Official Liquidator further submitted that based on the information available on ROC records, they were the Directors of the Company.

3. Considering the submission made by the learned Official Liquidator and the fact that the other two persons were the Directors of the Company in Liquidation at the relevant point of time as shown in the records of ROC, this Court feels that proposed respondent No.5, who is the Ex.Director of the Company, should be impleaded as respondent No.5. https://www.mhc.tn.gov.in/judis

4. Hence, the Registry is directed to implead proposed respondent No.5 as respondent No.5. The amendment shall be carried out on or before 22.02.2023. After carrying out the amendment, the Official Liquidator is directed to send notice to respondent Nos. 4 and 5 returnable by 31.03.2023 through Court as well as privately. Accordingly, this Application is allowed.
