O.P.No.1088 of 2018 R.SUBRAMANIAN.J., The petitioner seeks issuance of Probate in respect of the last Will and Testament of late Mr.V.S.Nagarajan dated 22.04.2004.

2. The said Mr.V.S.Nagarajan died on 23.05.2018. The petitioner has been appointed as Executor of the said Will. The petitioner has been examined as PW1. He has produced the death certificate of Mr.V.S.Nagarajan as Ex.P1. The original Will has been produced as Ex.P2. The sole respondent viz., the wife of the deceased Mr.V.S.Nagarajan has filed consent affidavit and the same has been marked as Ex.P3. The petitioner has also examined one Mr.A.Balamurthi as PW2. He has spoken about the execution of the Will by the Testator and its attestation by himself and one Mr.R.Raja.

3. Considering the said evidence, I find that the petitioner has proved the execution of the Will dated 22.04.2004 and he is entitled to Probate. Accordingly, this Original Petition is allowed granting Probate to the petitioner in respect of the Will dated 22.04.2004.
