Original Petition praying that this Hon'ble Court be pleased to prove the Will in common form and that probate thereof, to have effect limited to the State of Tamil Nadu may be granted to him.

This Original Petition coming on this day before this court for hearing the court made the following order: The petitioner seeks issuance of Probate for the Will dated 10.05.2017 executed by late Mr.M.Balakrishnan who died on 14.06.2017.

2. The petitioner has been appointed as Executor under the said Will. The petitioner has examined himself as PW1. https://hcservices.ecourts.gov.in/hcservices/ He has produced the Will as Ex.P1. The death certificate of the Testator has been produced as Ex.P2. The death

certificates of one Mr.B.Saravanan and Mrs.B.Lalith who are the children of the Testator have been produced as Ex.P3 and Ex.P4. Ex.P5 is the death certificate of Mrs.Vijaya Balakrishnan who died on 02.02.2017. The petitioner has also examined one Mr.N.Deepan as PW2. The said Mr.N.Deepan being attesting witness to the said Will has deposed regarding the execution of the Will by the Testator and its attestation by himself and one Mr.S.Gopal.

3. Considering the evidence available, I find that the petitioner has proved the Will in common form and entitled to Probate for the Will. Hence, this Original Petition is allowed granting Probate for the Will dated 10.05.2017. Sd/.R.S.M.J 25.04.2019 //Certified to be a true copy// Dated this the day of 2019.
