O R D E R

This Original Petition seeks appointment of an Arbitrator in respect of disputes arising out of the Construction Agreement dated 10.12.2014 as per the Supplementary Agreement dated 30.01.2015 entered into between the petitioner and respondent.

2. When the matter is called for hearing today, both the learned counsel agreed that Mr.V.Inbavijayan (Advocate) be appointed as Sole Arbitrator in this Original Petition to adjudicate upon the disputes inter se the parties as similar matter is dealt with by him.

3. Thus, I appoint Mr.V.Inbavijayan (Advocate) having office at G-2, Plot No.108, Majestic Colony, Valasarawakkam, Chennai 600 087 (Mobile No. 9840114287) as the Arbitrator to enter upon the reference and after issuing notice to the parties and upon hearing them, pass an award as expeditiously as possible within a period of six months from the date of receipt of the order. The learned Arbitrator is at liberty to fix his remuneration as well as schedule of expenses which shall be borne by both parties equally.

The proceedings may be conducted under the aegis of the Madras High Court Arbitration Centre and in accordance with the Madras High Court Arbitration Rules.

4. Requirement of Section 11(8) of the Arbitration and Conciliation Act, 1996 is dispensed with as the appointment is made with the consent of the respective counsel.

5. The Original Petition is ordered in the aforesaid terms leaving the parties to bear their own costs.
