Prayer: Contempt petition filed under Section 11 of the Contempt of Courts Act, 1971 to punish the respondent herein for willful disobedience of the order passed in W.P.No.9078 of 2017 dated 17.04.2017.

ORDER

(Order of the Court was made by M.M.SUNDRESH, J.) Alleging that the order dated 17.04.2017 passed by this Court in W.P.No. 9078 of 2017 has not been complied with, the present contempt petition has been filed.

2. Pursuant to the order passed by this Court, action was indeed taken. It was put to challenge before the Government by way of revision.

3. Revision was indeed preferred by the encroacher and though the Division Bench of this Court in W.P. No. 18825 of 2018 dated 23.07.2018 has granted only 12 weeks to dispose of the same, while maintaining the order of status quo, the same is yet to be disposed of.

1. We do not propose to pass any order against the Government in this proceedings. Unfortunately, the Government is not a party before us nor the encroacher. Therefore, the only option open to the petitioner is to implead himself in the pending revision or take any other action in accordance with law, if so advised.

5. In view of the above, this contempt petition stands closed.
