WMP.No.25682/2022 in WP.No.11430/2003 S.S.SUNDAR, J., and N.MALA, J., [Order of the Court was made by S.S.SUNDAR, J.,] The above miscellaneous petition is filed to set aside the order made in WP.No.11430/2003 dated 27.11.2007.

2.Though this petition is filed along with the petition to condone the delay of 276 days in filing the petition to set aside the order dated 27.11.2007, it is seen that the said petition in WMP.No.614/2009 was allowed by this Court vide order dated 23.09.2022 after satisfying with the reasons stated in the affidavit filed in support of the condone delay petition.

3.This Court finds that the petitioners have given sufficient reasons for the nonappearance of their learned counsel on 27.11.2007 and this Court is satisfied with the reasons stated in the affidavit filed in support of this petition.

4.Hence, the Miscellaneous Petition is ordered and the order dated 27.11.2007 made in WP.No.11430/2003 is set aside.

5.Registry is directed to post the main writ petition for final hearing on 17.10.2022.
