PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents 2 and 3 to consider the petitioner's representation dated 16.03.2018 seeking the packer post. O R D E R

The relief as such sought for in the present writ petition is for a direction to direct the respondents 2 and 3 to consider the petitioner's representation dated 16.03.2018, seeking the packer post.

2. The appointment can never be claimed as a matter of right. All appointments are to be made strictly in accordance with the rules in force. The writ petitioner seeks appointment as Packer in Fair Price Shops administered by the Co-operatives Societies. Thus, this Court of an opinion that the writ petitioner has not made out any cause, mere participation in the process of selection would not confer any right on the candidate to seek a direction to appoint him.

3. The learned Special Government Pleader appearing on behalf of the respondents states that, undoubtedly an interview was conducted. However, no appointment was made to the post of Packer in Fair Price Shops. In view of the fact that the selection was not proceeded with and no person was appointed, the writ petitioner cannot have any grievances and if at all any fresh notification for selection, the writ petitioner is at liberty to participate in the open competitive process, if otherwise qualified in accordance with the rules in force.

4. With these observations, the present writ petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
