Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus calling for the records relating to the impugned orders passed by the 2nd respondent in his Pro.Na.Ka.No.17976/2013/K.1(1) dated 14.12.2016 and the orders passed by the 1st respondent herein in his Pro.Na.Ka.No.12586/2017/DPC 2.2 dated 22.11.2017, quash the same and consequently direct the respondents to grant all monetary benefits to the petitioner herein. ORDER
This writ petition has been filed aggrieved by the impugned orders whereby the punishment of stoppage of increment for three years with cumulative effect was imposed on the petitioner and the same was confirmed by the appellate authority.

Today when the matter is taken up for consideration, it is brought to the notice of this Court by Mr.M.Murali, learned Government Advocate that the petitioner passed away on 15.09.2020 and the wife of the petitioner submitted a letter dated 12.06.2024 before the 2nd respondent stating that the she is not interested in pursuing the case and a copy of the said letter was also placed before this Court by duly serving on the learned counsel for the petitioner.

As the sole petitioner is no more and no steps were taken for bringing the legal representatives on record and also taking into consideration the letter dated 12.06.2024, placed before this Court, this Court is of the considered view that this writ petition will have to be closed, however, by granting liberty to the legal representatives of the deceased petitioner to seek Page No.2 of 4
re-opening of the writ petition by filing appropriate application, in the event they chose to pursue the writ petition.

Therefore, the writ petition is closed with liberty as observed above. The connected miscellaneous petitions, if any shall stand closed. No costs.
