(Order of the Court was made by Dr.ANITA SUMANTH,J.) The Registry ought not to have listed this matter today in view of the order passed on 27.08.2019 to the following effect:- "Even though notice was ordered on 28.06.2019, steps were not taken to pay batta.
2. Let fresh notice be issued to the 2nd respondent finally, returnable by 14.10.2019. We make it clear that in the event of failure on the part of the petitioner to take notice to the 2nd respondent, the writ petition would be dismissed summarily.
Post on 14.10.2019."
2. The cause-list reflects the report of the Registry to the effect that batta has not been paid.

3. Learned counsel for the petitioner submits that notice has been taken some time in 2023, but no affidavit of service to such effect has been filed.
4. In such circumstances and reiterating the direction under order passed on 27.08.2019, this writ petition is dismissed. No costs. Connected miscellaneous petition is closed.
