Karthikeyan v. Kumar

2026-03-03Honourable Mr Justice C.V. Karthikeyan,Honourable Mr.Justice K.Rajasekar2 pages

C.M.P.No.17250 of 2018 in A.S.No.75 of 2011 C.V.KARTHIKEYAN, J.

AND K.RAJASEKAR, J.

This petition has been filed seeking to bring on record the legal representatives of the deceased 2nd respondent as further respondents in the appeal. 2.The 2nd respondent was the 2nd defendant in the suit. There are three connected appeals. In A.S.No.111 of 2011, similar petition had been filed and legal representatives had been brought on record.

3.Since the legal representatives have a right to prosecute the appeal further, it would only be appropriate that, in this appeal also, the legal representatives of the deceased 2nd respondent are brought on record. In view of that particular fact, the petition stands allowed.

4.The Registry is directed to carry out necessary amendment in the cause title to the appeal suit.
