The counsel for the petitioner has been consistently absent even during 2019. It is seen from the records that the order challenged is one passed in a petition filed under Order 21 Rule 97 of C.P.C. Any order passed in a proceeding under Order 21 Rule 97 is treated as a decree in view of the Order 21 Rule 103 of C.P.C., and it is appealable. Hence, this civil revision petition is rejected as not maintainable. Consequently, connected miscellaneous petition is closed. No costs.
