Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondents herein to consider the petitioner's representation dated 08.01.2018.

ORDER

(Order of the Court was made by K.K.SASIDHARAN, J.) The petitioner filed this writ petition for issuance of a writ of mandamus directing the respondents 1 to 4 to take action against the respondents 5 & 6 and remove the encroachment on public pathway.

2. Heard the learned counsel for petitioner. We have also heard the learned Special Government Pleader on behalf of the respondents 1 to 4. None appears on behalf of the respondents 5 & 6 in spite of printing the name in the cause list.

3. The learned Special Government Pleader, on instructions, submitted that action has already been taken for removal of encroachment by issuance of notice to the respondents 5 & 6.

4. We direct the fourth respondent to consider the representation submitted by the petitioner on 8.1.2018 and take appropriate follow up action after issuing notice to the respondents 5 & 6. Such exercise shall be completed within a period of four months from the date of receipt of a copy of this order.

5. The writ petition is disposed of with the above direction. No costs.
